Miasto Świnoujście to jednostka podziału terytorialnego stopnia podstawowego oraz jego mieszkańcy, którzy tworzą wspólnotę samorządową.
Świnoujście od 1999 r. ma status miasta na prawach powiatu (tzw. powiatu grodzkiego). Zgodnie z art. 91 ustawy o samorządzie powiatowym z dnia 5 czerwca 1998 r., prawa powiatu przysługują Świnoujściu ze względu na to, iż status taki nadano miastu przy dokonywaniu pierwszego podziału kraju na powiaty, tj. Rozporządzeniem Rady Ministrów z dnia 30 listopada 1972 r. w sprawie utworzenia powiatu miejskiego Świnoujście (…).
